Booklet given to the jury at the 1979 trial
re: Jeffrey MacDonald's statements
At the 1979 trial, the prosecution provided the jury with a prepared booklet which had excerpts of MacDonald's pretrial statements on various key points. For example: "Actions upon first entering the master bedroom". It was these "exculpatory statements" which the government contended were false and that were against the physical evidence, which demonstrated consciousness of guilt. If someone is trying to understand why the jury convicted him, they need to know what he had said first. It isn't that the government simply proved he was lying, they proved that he was lying in an attempt to account for evidence which he knew would point to him as the criminal agent, like Colette's blood on his pajama top before it was torn. In the process he precluded himself from explaining away other incriminating evidence e.g. Kimberley's blood on his pajama top and the pajama top threads in the children's bedding. However, the key evidence - the alignment of the ice pick thrusts though his pajama top matching the ice pick wounds in Colette's chest - could not be ascribed to anyone else but MacDonald, because by his own account, he placed the pajama top on her chest after the hippies has allegedly fled.
