GOVERNMENT'S RESPONSE TO MOTION FOR NEW TRIAL
AFFIDAVIT OF KENNETH MICA
I, Kenneth Mica, being duly sworn do depose and say that:
(1) I am the same Kenneth Mica who testified at the trial of the above-captioned case in Raleigh, North Carolina (United States of America v. Jeffrey R. MacDonald) concerning my observations on February 17, 1970, as the military policemen at the crime scene at 544 Castle Drive, Fort Bragg.
(2) I have read the attached Declaration of Kenneth Edwards and based upon what I observed at the crime scene, I can state that the events were not as described by Kenneth Edwards.
(3) At no time was Colette MacDonald's body covered in any manner by a bed sheet.
(4) At no time was Jeff MacDonald seated on a bar stool in the living room, nor did he make the statements attributed to him by Kenneth Edwards.
(5) It is my recollection that Jeff MacDonald was placed on the ambulance gurney in the master bedroom and was wheeled directly down the hall and through the living room and out of the front door of the quarters.
