GOVERNMENT'S RESPONSE TO MOTION FOR NEW TRIAL

AFFIDAVIT OF WILLIAM F. IVORY

I, William F. Ivory, being duly sworn do hereby depose and say that;

(1) I am the same William F. Ivory who testified at the trial of the above captioned case in 1979 at Raleigh, North Carolina.

(2) I have read the Declarations of Kenneth and Rosalie Edwards.

(3) As I have previously testified, on the morning of February 17, 1970, I arrived in the living room of 544 Castle Drive, Fort Bragg, North Carolina and was being briefed by Lt. Paulk as Jeffrey MacDonald was being wheeled from the hallway and across the living room to the front door on a stretcher, called a gurney, by medical personnel. MacDonald was lying motionless on the gurney with his eyes closed. There was no conversation with MacDonald at that time and no one attempted any conversation with him.

(4) Subsequently, I entered the crime scene and when I observed the body of Colette MacDonald, only the blue pajama top and the Hilton bath mat covered it. The body was clothed at the time in pink pajamas.

(5) The only time I observed Colette MacDonald's body covered by a sheet was subsequent to the removal of the pajama top and bath mat, when medical personnel were removing her. At that time a sheet on the gurney was placed over the body to shield it from public view as it was loaded into the ambulance.
