SUBJECT: Request for Investigation

Lieutenant General John J. Tolson
Commanding General
XVIII Airborne Corps and Fort Bragg
Fort Bragg, North Carolina 28307

1. On 11 December 1970, I received a copy of a request for investigation dated 6 December 1970 from ILT Michael J. Malley, the individual military counsel for CPT Jeffrey R. MacDonald. As of this date, I have not been officially informed whether an investigation of the allegations made by LT Malley will be conducted but have learned through newspaper articles that an evaluation of the handling of the MacDonald case by the Fort Bragg Criminal Investigation Division is being conducted. As CPT MacDonald's detailed military counsel from 6 April 1970 until his discharge on 5 December 1970, I was in a position to gain extensive knowledge of the investigation of the murders of his wife and children and the charges against CPT MacDonald.

2. While I do not have personal knowledge that would allow me to testify on all allegations set forth in LT Malley's request for investigation, I can give evidence from my own personal knowledge which supports a number of the serious allegations made by LT Malley. In addition, I have in my possession certain photographs, tape recording and transcripts of interviews and conversations with Criminal Investigation Division Agents and others connected with the investigation and presentation of the charges against CPT MacDonald which not only corroborates some of the allegations made by LT Malley but also indicates the commission of other illegal, unethical, or wantonly derelict acts by these individuals. These acts include but are not limited to slander, the harassment and attempted intimidation of both the family and attorneys of CPT MacDonald and a complete disregard of potentially important information offered by other police agencies and defense attorneys.

SUBJECT: Request for Investigation

3. If any investigation is to be made into the serious allegations made in the Request for Investigation of LT Malley and the public assertions by CPT MacDonald and his family and civilian attorneys, I feel that the evidence in my possession sustaining these charges should be placed before proper authorities. For the above reasons, I will retain the evidence in my possession until it can be presented to a properly constituted Board of Investigation.
